A State Property Rights Victory for Kaplin Stewart Against the Railroad

Marc Kaplin, Esq. and Pamela Tobin, Esq. of Kaplin Stewart in Blue Bell, Pennsylvania have secured a precedent-setting state rights victory in the Third Circuit Court of Appeals for their client, the MacDade Boulevard Mall. The lawsuit was filed as a result of a dispute over CSX Transportation, Inc.’s failure to control the storm water runoff from its railroad track adjoining the Mall property. The trial court agreed with CSX that it was immune from liability under the Federal Railway Safety Act. Marc Kaplin argued the Mall’s case before the Third Circuit Court of Appeals which reversed the trial court’s decision, holding that the federal regulation did not authorize CSX to discharge its storm water directly onto the Mall’s property. The Appeals Court concluded that the regulation was never intended to give the railroad the authority to disregard state property rights. The decision is a vindication of state rights.

Mohammad A. Ghiasuddin, Esq., a principal of Kaplin Stewart in Blue Bell, Pennsylvania, has been appointed by the Montgomery County Bar Association as Chair of the Diversity Committee for 2013, his second year in that position. Mr. Ghiasuddin has been an active member of the Diversity Committee since its founding in 2008. He is a member of the Commercial Litigation and Construction Law groups and represents contractors, construction managers, bonding companies and design professionals along with other businesses in a variety of industries.

Joshua C. Quinter, Esq., a principal of Kaplin Stewart in Blue Bell, Pennsylvania, has been appointed by the Montgomery County Bar Association as Chair of the Construction and Public Contract Law Committee for 2013. Neil Andrew Stein, Esquire, served as a judge for the American Bar Association’s Client Counseling Competition held on November 17, 2012, at the Temple University School of Law. The national competition, for first and second year law students, simulates a law office consultation in which the law students, acting as attorneys, are presented with a hypothetical client matter for consultation and analysis. Mr. Stein, a Temple Law Alumni, is a co-founding shareholder and a member of the Land Use Department of Kaplin, Stewart, Meloff, Reiter & Stein, with offices in Pennsylvania and New Jersey.
